Terms of Service

These Terms govern your use of the website ichek.info and of the services provided by iSec Services Private Limited, trading as iChek Services ("iChek", "we", "us"), including background verification, corporate due diligence, and the Address Verification API.

By placing an order, creating an account or using our services, you agree to these Terms. If you have signed a separate written agreement with us, that agreement takes precedence where the two differ.

1. Our services

We provide:

• Employee and individual background verification: checks on education, employment, references, address, criminal records, national identity documents, databases and drug testing.
• Corporate due diligence: business, business partner, leadership and investment risk due diligence.
• The Address Verification API: a checkout widget, REST API and bulk tools that check and standardise delivery addresses, and, on the Pro plan, score orders for return-to-origin risk.

We provide a verification and information service. We are not a credit bureau, a law enforcement agency or a legal adviser, and our reports are not legal advice.

2. Who may use them

You must be 18 or over and able to enter a contract. Business services are for organisations acting for a lawful purpose, such as recruitment, onboarding, tenancy, engaging domestic staff, or assessing a business relationship. You confirm that the information you give us is true and that you are authorised to give it.

3. Your obligations

• Give complete and accurate details of the person or company to be checked. Wrong details delay a check and may make it impossible.
• Use the reports only for the purpose you ordered them for.
• Keep reports confidential and share them only with people in your organisation who need to see them.
• Comply with all applicable laws, including data protection and employment law.

4. Candidate consent

You confirm, for every check you order, that you have obtained the written consent of the person being checked, that you will keep the record of it, and that you will produce it to us on request. You are responsible for this consent. If we discover that a check was ordered without consent, we may stop work immediately, without a refund, and report the matter as the law requires.

5. Accounts and API keys

• You must give a valid email address and confirm it before your account is activated.
• Keep your password and secret key (sk_) private. Never place a secret key in a web page, an app or a public code repository. Your publishable key (pk_) is designed to be used in the browser and should be restricted to your own domains.
• You are responsible for everything done through your account and keys. Tell us at once if you think they have been exposed, and rotate them from your dashboard.
• Free plan usage is capped at the number of checks shown in your dashboard each month. Calls beyond that limit are refused until the next month or until you upgrade.
• We may apply fair rate limits to keep the service stable for everyone.

6. Fees, taxes and payment

• Prices for individual checks are shown at checkout before you pay. Prices for corporate work and for volume agreements are quoted separately.
• Indian orders are subject to GST at 18%, shown separately at checkout.
• Payment is taken in advance through our payment partner. Work begins once payment is confirmed.
• Prices may change, but a change never affects an order already paid for.
• For invoiced accounts, payment is due within the days stated on the invoice. Overdue amounts may lead to services being paused.

7. Turnaround times

The turnaround time shown for each check is a working-day estimate that begins once we have payment and all the details we need. Times depend on third parties such as universities, employers, police stations and courts, so delays outside our control do happen. We will keep you informed where a check is running late. The Address Verification API is delivered instantly and is intended to be available at all times, though it may be unavailable during maintenance or events beyond our control.

8. Accuracy and your decisions

We take care to verify information from authentic sources and to report it accurately. However:

• We report what the source tells us. We are not responsible for errors in the records held by a university, employer, police station, court or government database.
• Address checks and risk scores are indicators, not guarantees. The Address Verification API returns a status and a score to help you decide; the decision to accept, hold or refuse an order is yours.
• Any decision to hire, engage, rent to, invest in or do business with a person or company is yours alone. We are not responsible for the outcome of that decision.
• If you believe a report is wrong, tell us within 30 days and we will re-verify the disputed point free of charge.

9. Acceptable use

You must not use our services to:

• check anyone without a lawful purpose and their consent, including stalking, harassing or profiling a private individual;
• discriminate unlawfully;
• resell, republish or redistribute our data or reports without our written agreement;
• copy, scrape or reverse-engineer the service, or work around its limits or security;
• submit false, fabricated or unlawfully obtained data;
• overload, interfere with or attempt to gain unauthorised access to our systems.

10. Confidentiality and data protection

Each of us will keep the other's confidential information in confidence. We handle personal data as described in our Privacy Policy. Where we process personal data on your instructions, you are the data fiduciary and we are the data processor, and each of us will meet our obligations under the Digital Personal Data Protection Act, 2023.

11. Intellectual property

The website, the API, the widget, our software, our report formats and our brand names belong to us. We grant you a non-exclusive, non-transferable right to use them while your account is active and for the purpose of the service. Reports we deliver to you are yours to use inside your organisation for the purpose you ordered them for. You may not remove our notices or use our name or logo publicly without our written permission.

12. Liability

Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence. Subject to that:

• our total liability for all claims arising in any 12-month period is limited to the fees you paid us for the service in question during that period;
• we are not liable for indirect or consequential loss, or for loss of profit, business, goodwill, or data;
• we are not liable for decisions you make on the basis of a report, or for a third party's inaccurate records;
• services are otherwise provided "as is", and we do not guarantee that they will be uninterrupted or error free.

13. Suspension and termination

You may close your account at any time by writing to us. We may suspend or end your access, with notice where it is reasonable to give it, if you breach these Terms, if payment is overdue, if we are required to by law, or if your use puts our systems or other customers at risk. On termination, your right to use the service stops. We keep records for the periods set out in our Privacy Policy. Fees already due remain payable, and our refund rules are in the Refund & Cancellation Policy.

14. Events outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, civil unrest, war, government action, failures of power or telecommunications, internet or hosting outages, or the closure or non-response of a verification source.

15. Governing law and disputes

These Terms are governed by the laws of India. The courts of Mumbai, Maharashtra have exclusive jurisdiction. Before starting proceedings, both sides agree to try in good faith to resolve the dispute by discussion within 30 days of written notice.

16. Changes to these Terms

We may update these Terms. The date at the top shows the current version. Material changes will be notified by email or by a notice on the website at least 15 days before they take effect. Continuing to use the service after that date means you accept the new version.
